A Malawian court has ruled that US pop star Madonna has failed in her bid to adopt a second child from the country.

“I must have to decline to grant the application to Madonna,” judge Esmie Chondo said in a ruling following a closed-door hearing on Friday.

The application has been rejected over residency rules.

Madonna, who flew to Malawi on Sunday, was not in court to hear the ruling over Chifundo James, three. It is not clear if she will appeal against it.

The 50-year-old singer applied to adopt Chifundo James, whose name translates into English as Mercy, on Monday.

Alex Rodriguez’s relationship with Madonna was “an affair of the heart” – not “sexual infidelity” – according to Cynthia Rodriguez’s lawyer. 

Still, the baseball star’s relationship with the singer “was the last straw” before the Yankee slugger’s wife filed for divorce Monday, her Houston attorney, Earle Lilly, tells PEOPLE. 

Lilly says that A-Rod was smitten with Madonna, but makes no claim of any sexual liaison. “The correct analysis is a relationship,” he says. “Some people categorize an affair as something as sexual infidelity. We’re not claming that. It’s an affair of the heart.” 

Over the weekend, Madonna issued a statement to PEOPLE denying a romantic relationship with the baseball star, saying, “I have nothing to do with the state of his marriage.” 

In fact, “Madonna’s name is not even mentioned in the papers,” says Lilly. “We don’t want the public to think this is an aggressive action against Madonna.”

Still, Lilly maintains that A-Rod has behaved badly for “a good while” and his client, Cynthia Rodriguez, has had enough. “She’s just a Greek Orthodox lady who has had as much as she can take,” he says.

A-Rod’s wife Cynthia Rodriguez believes Madonna used kabbalah to brainwash her husband and convince him to leave her, according to a new report in New York’s Daily News.

“I feel like Madonna is using mind control over him,” Cynthia, 34, told a pal, according to the News. “I don’t recognize the man he’s become. He was a sweet, beautiful, loving husband and father.

“Today, he’s very cold and calculating,” she added.

(On Thursday night, Cynthia’s father John Scurtis told Usmagazine.com that A-Rod had taken up the religion, “which isn’t something we understand.”)

Cynthia – who is “devastated” about splitting with her husband of five years – also “found a letter where Alex told Madonna: ‘You are my true soul mate,’” a source close to the couple told the News.

Alex Rodriguez’s wife has been seeing Lenny Kravitz, according to the New York Post, as the New York Yankee has befriended Madonna, Kravitz’s ex.

As Madonna and husband Guy Ritchie stepped out holding hands amid reports of a potential split, Kravitz and Rodriguez’s wife Cynthia have been “spending cozy time” in Paris for at least the past four days, the paper reports.

Cynthia and Rodriguez ” who wed in 2002 and have two young daughters ” attended NBC’s New Year’s Eve 2008 party where Kravitz performed.

Madonna, 49, and Kravitz, 44, collaborated on her 1990 hit “Justify My Love.” The pair was romantically linked at the time.

Another connection? Rodriguez, Madonna, and Kravitz all have the same manager: Guy Oseary.

Oseary sat in Rodriguez’s seats at a Yankees game with Madonna and her kids on June 22.

Kravitz attended Madonna’s private showcase of her latest album, Hard Candy, in Paris on May 6. He also joined the Material Girl on stage for a performance of her song “I Love New York” in Paris in September 2006.

Us Weekly reports in its new issue, on newsstands now, that the singer has also been hosting late-night visits from Rodriguez, 32, at her apartment.

A source tells Us that their relationship grew so close that he possibly visited her as early as the night after his wife Cynthia gave birth to their second child in April.

Now that it’s semi-official that Madonna and Guy Ritchie are on the verge of a divorce, it’s time to find out why – and apparently ‘because he’s Guy Ritchie’ isn’t a valid answer.

One theory that’s currently doing the rounds is that Madonna has been getting closer and closer to New York Yankees baseball star Alex Rodriguez. So close, in fact, that Rodriguez apparently made a secret late-night visit to Madonna’s apartment almost immediately after his wife gave birth to their second child.

If these reports are true, then it looks like Madonna and Guy Ritchie’s marriage is done for. Still, it’s not all bad. True, Guy Ritchie will be losing the love of his life and the mother of his son forever, but at least he won’t have a veiny middle-aged woman hanging around all the time yattering away in the world’s least convincing British accent with her vagina hanging out. Swings and roundabouts, really.
